ARTICLE 1. TERMS AND DEFINITIONS

The terms and definitions used in these general conditions of carriage (hereinafter also referred to as “G.C.C.” or “General Conditions” or “General Conditions of Carriage”) have the following meanings:

Aeroitalia

Airline with registered office in Fiumicino, Via Andrea Mantegna 8, 00054 Fiumicino VAT 16340701008 and registration number in the Rome Companies Register 16340701008, indicating the contracting party of the following General Conditions of Contract.

Authorized Agent

Refers to a natural or legal person authorized by the Carrier to represent it in the sale of Air Transport tickets.

High Season

Period of the year when there is higher passenger traffic.

Pet

Refers to a pet traveling in the cabin along with a Passenger.

Prohibited Items

Guns, firearms, and other devices that discharge projectiles; stunning devices; objects with a sharp point or edge; work tools that can be used to cause serious injury or threaten the safety of aircraft, including drills, saws, welders, etc.; blunt instruments and objects that can be used to cause serious injury when used to strike; explosive and incendiary substances and devices; LAG (Liquids, Aerosols, and Gels), unless such liquids are contained in individual containers with a capacity not exceeding 100 milliliters or equivalent (e.g., 100 grams), to be carried in a transparent, resealable plastic bag, fully closed, with a capacity not exceeding 1 liter (approximately dimensions such as about cm 18 x 20) separately from other hand luggage. A transparent, resealable plastic bag is defined as a container that allows the contents to be easily seen without the need to open it and that has a fully sealing system, such as a zip or pressure closures, or a closure that can be resealed after being opened.

Baggage

Means all personal effects and other belongings accompanying the Passenger during the trip. Unless otherwise specified, this term includes both Checked Baggage and Unchecked Baggage, as defined below. Baggage also includes a Pet accompanying the passenger, subject to the provisions of Article 8.3 of these General Conditions.

Checked Baggage (hold baggage)

Refers to Baggage accepted in custody by the Carrier for which an Identification Receipt has been issued. Aeroitalia – General Conditions of Carriage v3 of 1/06/2023

Unchecked Baggage (cabin baggage)

Refers to any baggage other than checked baggage that is not entrusted to Aeroitalia and is carried in the cabin.

Free Baggage Allowance

Refers to the maximum amount of baggage, determined by the Carrier based on numerical and/or weight and/or size criteria, that each Passenger can carry with them.

Low Season

Period of the year when there is lower passenger traffic.

Boarding Pass

Refers to the named document issued upon acceptance on the flight, printed by the Passenger online before each flight, or issued in another format directly by Aeroitalia or its representative at the departure airport.

Force Majeure

Unexpected circumstances that are impossible to foresee, beyond the control of the passenger and the airline, whose consequences are impossible to avoid despite all precautions that may be required.

Fare Bundles

Fare bundles are identified by a specific name that corresponds to a fare level with its own rules. Each fare bundle corresponds to a specific type of service based on the Carrier's offer at the time of purchase.

Carrier Identification Code

Refers to the identification code assigned by IATA to each carrier member of the association. The code consists of two or more alphabetic, numeric, or alphanumeric characters and is indicated on the travel receipt and the Ticket next to the flight number.

Transport Contract

Is the transport contract for the Air Transport to be performed by Aeroitalia for the Passenger concerning a specific Itinerary under the terms and conditions stated in the Itinerary Receipt and the Ticket, identified as such and including these General Conditions of Carriage and the passenger warnings. The transport contract is concluded with the creation of the booking, and the General Conditions of Carriage published on the Aeroitalia website at the time of purchase apply to the contract.

Administrative Costs

Refers to the costs applied, where provided by the Carrier and/or its Authorized Agent, for the issuance, modification, or refund of the purchased booking/ticket. The Carrier or its Authorized Agent must inform the Passenger of the amounts of the Administrative Costs. Aeroitalia – General Conditions of Carriage v3 of 1/06/2023

Damages

Includes death, bodily injury, losses due to delays, loss, or other damages of any kind arising from or connected with transport on flights or other services rendered by the Carrier.

Personal Data

Any type of personal information related to an individual, such as name, surname, address, email address, identity document number, expiration date, etc.; or reference to the individual's physical and psychological traits: genetic, mental, economic, cultural, etc.

Identity Document

An identity document is a document issued by a State authority certifying the identity of its holder.

SDR

Refers to the Special Drawing Right as defined by the International Monetary Fund.

Baggage Tag

Refers to the part of the Identification Receipt affixed to Checked Baggage.

Group

A minimum number of passengers (10), traveling together on a predetermined route, following the conclusion of a travel contract with the carrier.

IATA

International Air Traffic Association, the global organization of Airlines.

IATA Summer

Refers to the IATA season starting on the last Sunday in March and ending on the last Saturday in October.

IATA Winter

Refers to the IATA season starting on the last Sunday in October and ending on the last Saturday in March.

Infant

A person aged between 0 and 24 months at the date of the presumed trip, who cannot be assigned a seat on the aircraft and must travel on the lap of an adult passenger.

ICAO

International Civil Aviation Organization, a specialized agency of the UN dealing with issues related to civil aviation regulation.

Itinerary

Means all the Segments included in the Passenger's Travel Receipt. Aeroitalia – General Conditions of Carriage v3 of 1/06/2023

Emergency Flight Interruption

If a passenger's health deteriorates on board the aircraft and the airline is forced to make an emergency landing at the nearest airport so that the passenger can receive the necessary medical care, the passenger will be responsible for all medical expenses and all accommodation expenses for accompanying persons and for future transportation costs from the unplanned stopover point to the final destination. The airline recommends passengers purchase valid medical and transport insurance for travel.

Unaccompanied Minor

Any person aged between 6 and 14 years (6-18 years for citizens of other nationalities) at the time of the date of travel and traveling without an escort who has reached 18 years of age at the date of travel.

Charter

Refers to the operation by which any other party that has concluded a contract with the Passenger (e.g., a tour operator) assigns the Carrier the task of performing Air Transport. CHARTER/CODE-SHARE OPERATIONS - If the transport is carried out under a charter contract or a code-sharing agreement, the Conditions of travel apply to the extent that they are incorporated, by reference, into the charter/code-share contract. Any claims relating to transport services performed under a code-sharing agreement must be submitted to the actual operating carrier.

Applicable Regulations

Applicable regulations refer to all the rules from time to time applicable to Air Transport. These rules are not an integral part of the Transport Contract and are subject to changes over time by the competent legislative and regulatory body.

Schedules

Refers to the timetable of aircraft departure and arrival times, as listed in the official schedules published by the Carrier on its website and in sales systems.

Stretcher service

A special service provided for passengers who are unable to sit in a normal aircraft seat due to medical conditions, requiring them to be transported on a stretcher.
 

Off block

The moment when the aircraft starts moving under its own engine power from a gate or parking position to prepare for takeoff.

On block

The moment when the aircraft reaches its final stop at a gate or parking position after landing.

Passenger

Refers to any natural person, not part of the crew, holding a confirmed Travel Receipt typically issued upon payment of a fare.

Passenger with Reduced Mobility

Refers to any passenger whose mobility is reduced when using a means of transport due to a disability, whether permanent or temporary, whose condition requires special attention and adaptation of the services offered to all Passengers to meet their needs. Booking

Refers to a request for Air Transport made by a Passenger and recorded by the Carrier or its Authorized Agent.

Price

Is the amount the customer must pay for the Aeroitalia service, consisting of the total fare plus any additional services (paid seat, baggage, ancillary purchases) and airport taxes.

Property Irregularity Report – PIR

Baggage irregularity report; it is a report that certifies the irregularity concerning a passenger's baggage, such as loss, delayed delivery, or damage. It must be completed at the baggage assistance office before leaving the arrival airport. It is a crucial component for initiating the baggage claim process.

Baggage Receipt

Refers to the part of the Identification Receipt issued to the Passenger, proving the transportation of Checked Baggage.

Itinerary Receipt

Refers to one or more documents issued by the Carrier or its authorized agent to the Passenger, containing the Passenger's name, flight information, and passenger warnings.

Route

Is the travel segment operated by the carrier, from the point of departure to the final destination.

Identification Receipt

Refers to a tag issued by the Carrier solely for the identification of Checked Baggage and consists of a part affixed to the Baggage ("Baggage Tag") and the Baggage Receipt.

Special Services

These are assistance services for passengers in need of special attention, such as passengers with reduced mobility, unaccompanied minors, etc.

Website

Refers to the website www.aeroitalia.com

Stopover

An interruption of the journey at an intermediate stop, indicated on the Ticket or Aeroitalia schedules as a scheduled stop along the planned itinerary or made for operational and/or safety reasons.

Hold

Is the part of the aircraft designated for housing checked baggage, cargo, and mail.

Fare

Refers to the fare of an Air Transport booked by a Passenger, in an eligible class, for a specific Itinerary, flights, and dates, excluding Administrative Costs and taxes. Aeroitalia – General Conditions of Carriage v3 of 1/06/2023

Check-in Deadline

Refers to the deadline, set by the Carrier, by which the Passenger must have obtained the Boarding Pass and completed all baggage check-in procedures.

Travel Document

Is the transport document, purchase/booking receipt, issued by Aeroitalia or its authorized Agent, either electronically or in paper form, documenting the Transport Contract and entitling the holder to Air Transport.

Air Transport

The air transport provided under the Transport Contract.

Leg

Refers to each individual segment of a domestic or international flight.

Personal Data Processing

Any operation or set of operations performed on personal data or sets of personal data, whether or not by automated means.

Carrier

Is the legal entity that performs the air transport, which can be either the Contractual Carrier or the Actual/Operating Carrier. The first refers to the carrier with which the Passenger has entered into the Transport Contract and whose identification code is shown on the Itinerary Receipt or Ticket; the second refers to the carrier that actually operates the flight under an agreement with the Contractual Carrier.

International Flight

Refers to any flight in which the place of departure and the place of destination are located in the territory of at least two states.

Domestic Flight

Refers to any flight in which the place of departure and the place of destination are within the same state in territorial continuity.

Check-in

Procedure for registering passengers and their baggage, and for issuing the boarding pass and any baggage tags, for a specific flight, in accordance with the services reserved and paid for by the passenger in the manner and times specified by the carrier.

DEPA

A person for whom a deportation order has been issued, who is accompanied by special escort appointed by the authorities.

DEPU

A person for whom a deportation order has been issued, who is not accompanied by special escort.

Priority Boarding Service

Service that offers passengers priority boarding onto the aircraft compared to other passengers, as well as the ability to check in an additional carry-on baggage, weighing up to 10 kg and with maximum dimensions of 55x40x20 cm.

ARTICLE 2. APPLICABILITY AND JURISDICTION

2.1 General

These general conditions of carriage apply exclusively to air transport services that are the subject of the transport contract or otherwise to air transport operated by Aeroitalia, identified by the carrier code indicated in the booking and boarding pass. All Air Transport is subject to the carrier's general conditions of carriage and fare rules in effect on the date of the booking made by the passenger. These general conditions of carriage can be consulted on Aeroitalia's website.

2.2 Charter Contract

If Air Transport is carried out (also) under a charter contract, these Conditions of Carriage also apply to such a contract, regardless of whether the conditions of carriage are specifically mentioned or cited in the aforementioned charter contract.

2.3 Prevalence of the Law

These General Conditions of Carriage apply provided they are not contrary to the prevailing law and public order rules, in which case the latter will prevail. The nullity of one or more clauses of these general conditions of carriage will not affect the validity of the remaining clauses unless the transport contract cannot be applied without the clause declared null or ineffective, as it is decisive and essential for the existence of the contract.

ARTICLE 3. BOOKING CONDITIONS AND DOCUMENTATION

3.1 General Provisions

Aeroitalia will provide transport only for the passenger(s) indicated on the relevant Itinerary Receipt. To this end, Aeroitalia will require the passenger(s) to prove their identity and, in any case, to comply with the rules regarding documents indicated in Article 6.5, as well as any other applicable provisions relevant to air transport. Unless proven otherwise, with regard to the stipulation and content, the Itinerary Receipt certifies the existence of a transport contract between the carrier and the passenger whose name appears on the receipt. Only the passenger(s) indicated on the receipt/booking are entitled to the transport service; travel documents are transferable upon name change according to fare conditions.

3.2 Booking

Passengers can make their bookings through the following sales channels:

  1. website www.aeroitalia.com
  2. travel agencies including third-party sites;
  3. airport ticket offices

Bookings will be considered confirmed only after they are recorded in the Carrier's computer system; if the passenger does not settle the payment for the reserved seat at the time of booking or by the communicated final issuance date, the booking will be canceled and the seat will be assigned to another passenger without any liability on the part of the Carrier. Some itineraries sold at special fares are completely non-refundable. The booking code is indicated on the website at the end of the purchase transaction and subsequently sent via email; if necessary, a duplicate can be requested using the Customer Assistance contact form available on the official website www.aeroitalia.com. Passengers do not need to reconfirm bookings for which a receipt with a code has been regularly issued. A ticket purchase can be made up to 3 hours before the desired flight departure. Transactions executed within three hours of the desired flight departure may not be visible during check-in, requiring the passenger to make a new purchase. Aeroitalia is not responsible if the passenger shows up at check-in without having paid for their seat and may refuse to board the passenger, without them being able to benefit from their rights under EC Regulation 261/2004 in terms of monetary compensation. The passenger has the duty to verify the transaction and receipt of the itinerary after booking issuance and/or any further modifications or service additions.

3.3 Booking Changes and Modifications

The booking is valid exclusively for the specified itinerary, date, and flight number, from the point of departure to the final destination, and for the passenger whose name is indicated on the booking. Date/flight changes, name changes, adding services such as baggage, seat assignment, or bundle upgrades are permitted. Voluntary changes to the travel route are not allowed. If the passenger wishes to modify their booking or add ancillary services after finalizing the booking and purchasing their seat, they must adhere to the following terms:

3.3.1

Passengers who have received a booking confirmation and purchase can make a date/time change up to 3 hours before departure (excluded PSO fares), subject to a change fee per passenger/segment. The cost can be verified in the Fees and Supplements table. Any fare adjustment between the new fare and the previously purchased fare will be added to the total modification cost. For tickets purchased in the BIZ booking class, the date/time change is penalty-free and unlimited. Any fare adjustment between the new fare and the previously purchased fare will be added to the total modification cost.

3.3.2

A passenger who has done web check-in and wishes to make a booking change must cancel the online check-in by contacting Customer Assistance, make the desired change, and then complete the web check-in again.

3.3.3

Name change can be made up to 3 hours before departure (excluded PSO fares), subject to a change fee per passenger/segment. The cost can be verified in the Fees and Supplements table. The name change will not be applicable if the request is made after the journey has started.

3.3.4

The purchase of ancillary services up to 3 hours before departure is always allowed; it may be subject to availability in case of limited service and is not included in the above-mentioned changes. Ancillary services are also non-refundable.

3.4 Booking Cancellation

In case of voluntary cancellation of the booking by the passenger after completing the purchase transaction, the conditions set forth in Article 4.2 will apply. The voluntary cancellation request must be sent through the contact form on the Aeroitalia website within 3 hours before the flight departure.

3.5 Personal Data

To make a Booking, obtain complementary services, facilitate immigration and entry formalities into the territory of a state, the passenger is required to provide some personal data to the carrier or its authorized agent. These personal data, communicated to the carrier for purposes related to the stipulation and fulfillment of the transport contract, may be processed using computer tools. These data are collected and processed in compliance with EU Regulation 2016/679 (hereinafter "GDPR") and Legislative Decree of June 30, 2003, no. 196 and subsequent amendments. If the passenger does not authorize or revokes their consent to the processing of such data, Aeroitalia may not be able to provide, in whole or in part, the services requested by the passenger. If flight changes and/or cancellations are necessary, or other communications are required, Aeroitalia will inform the passenger by sending a communication to the email address and a text message to the mobile phone provided at the time of booking.

3.6 Seat Assignment

At the time of booking, the Passenger may request the assignment of a specific seat on board by paying a fee. If no seat is chosen, Aeroitalia will automatically and free of charge assign a seat at check-in, according to availability. Aeroitalia is authorized to assign or reassign seats at any time, even after boarding the aircraft. This may be necessary for operational or safety reasons. If the Passenger has paid for a seat reservation and the flight is canceled or the seat is reassigned to another category for operational or safety reasons, they are entitled to a refund of the reserved seat category cost. No refund is made if the passenger voluntarily does not take the flight, if they change the date or if incorrect data about their suitability to occupy a seat near the emergency exit were provided when booking. Passengers who are not eligible to occupy seats in the front rows and/or emergency exits are:

  1. passengers traveling with infants (newborns) and minors under 18 years;
  2. passengers with disabilities or reduced mobility;
  3. unaccompanied minors;
  4. passengers in particular medical conditions;
  5. passengers with accompanying animals;
  6. passengers with fragile and/or bulky baggage and/or musical instruments transported according to Article 8.5.4;
  7. passengers denied entry into the destination country or deported.

No refund will be issued if the passenger voluntarily cancels the flight or makes a voluntary date change.

 

3.7 Payments

Unless otherwise communicated by Aeroitalia, the person who made the reservation is required to pay the full amount due at the time of booking.

Payment methods may vary depending on the website, app, or sales channel being used. Accepted payment options include Visa, Mastercard, and Maestro debit or credit cards, as well as a PayPal account.

Aeroitalia advises that the improper use of chargeback procedures to the detriment of the company will result in an irrevocable blacklist entry, blocking the payment method used and rendering it unavailable for future reservations.

In such cases, Aeroitalia also reserves the right to initiate any appropriate action against the user for the recovery of outstanding amounts and for compensation for damages incurred.

 

 

 

ARTICLE 4. FARES, TAXES, AND SUPPLEMENTS

4.1 Fares

Unless otherwise indicated, the Fares applied to the itinerary include only Air Transport from the airport of the place of departure to the airport of the place of destination. Prices do not include ground transportation services between airports and city terminals, nor any other services not expressly mentioned in the Itinerary receipt/booking. The flight price may include supplements applied by the Carrier. Each fare will be calculated in accordance with the fares in effect on the booking date for travel to be made on the dates and for the itineraries indicated on the Itinerary receipt. Any change of date or Itinerary may result in a change in the applicable fare. The applicable fares are those calculated based on the rules in effect on the purchase date, as published by the carrier, in a specific class of transport. At the time of booking, the passenger is informed of the total price of the itinerary, including fare, taxes, and any additional service costs if requested by the passenger.

4.2 Fare Rules

When booking the flight, the passenger can choose between the following travel classes (bundles): BASIC, CLASSIC, or BIZ.

Basic includes:

  • Small carry-on bag 40x30x20cm
  • Free online check-in available 24 hours before departure
  • Changes allowed as indicated in Article 3.3 of these Conditions of Carriage.
  • Non-refundable fare.

Classic (for tickets issued up to and including June 18, 2025):

  • Small carry-on bag 40x30x20cm;
  • Pre-assigned seat, excluding seats in the first four rows and emergency exits;
  • 1 piece of checked baggage up to 23 kg;
  • Free online check-in available 30 days before departure or at the airport;
  • Changes allowed as indicated in Article 3.3 of these Conditions of Carriage;
  • Non-refundable fare.

Classic (for tickets issued from June 19, 2025):

  • Small cabin bag 40x30x20 cm
  • Pre-assigned seat, excluding the first four rows and emergency exit seats
  • Large cabin bag 55x40x20 cm
  • Priority boarding
  • Free online check-in available 30 days before departure or at the airport
  • Changes allowed as per Article 3.3 of these Conditions of Carriage
  • Non-refundable fare

The bundle composition remains valid on the day of travel, even in the event of a schedule change or delay, according to the version in effect at the time of purchase.
In the case of a voluntary date change, the new bundle composition in effect at the time of the change will apply.

Biz includes:

  • Small carry-on bag 40x30x20cm
  • Pre-assigned seat, including seats in the first four rows and emergency exits;
  • 1 piece of checked baggage up to 32 kg;
  • Priority boarding;
  • Large carry-on bag 55x40x20cm/10kg;
  • Free priority online check-in 30 days before departure or at the airport;
  • Unlimited date/time changes without penalty, as indicated in Article 3.3 of these Conditions of Carriage;
  • Non-refundable fare.

4.2.1 Fares for flights operated under Sardinia’s territorial continuity regime.

Fares for flights operated under the Territorial Continuity scheme apply to the following passengers:
Category A – Residents and equivalent categories (“residents & co.”)

  • passengers resident in Sardinia
  • disabled passengers (*) (**) and their accompanying person (*) (***)
  • university students up to 27 years of age (*)
  • young passengers aged between 2 and 21 years (*)
  • passengers over 70 years of age (*)
  • military personnel assigned to a permanent work location in Sardinia (*)
  • employees assigned to a permanent work location in Sardinia (*)
  • non-professional competitive athletes registered with a sports association based in Sardinia (*)

(*) Without any discrimination related to nationality and/or residence
(**) Civil disability with a percentage equal to or greater than 80%, certified by a medical commission
(***) Where required by medical documentation

Category A fare includes:

  • Priority boarding
  • One cabin baggage up to 10 kg (55×40×25 cm)
  • One checked baggage up to 23 kg

Musical instruments and sports or technical equipment may also be included in the checked baggage allowance, provided the total weight does not exceed 23 kg.

Fare rules – Category A

  • Only one ticket per passenger per day per route may be issued.
  • Flight/date changes are permitted free of charge up to 1 hour before scheduled departure.
  • Route changes are permitted up to 1 hour before departure, exclusively through Customer Service. Any applicable fare difference may apply.
  • For sports associations or teams, name changes are permitted free of charge, exclusively through Customer Service, provided the replacement passenger belongs to the same association/team and performs the same role.
  • For all other passengers, name changes are permitted up to 1 hour before departure. The cost of the service is indicated in the “Taxes and Surcharges” table.
  • Ticket refunds are permitted if requested through the Contact Form, with documentation proving eligibility for the fare category, no later than 1 hour before scheduled departure.
  • Failure to show up for boarding (no-show) will result in the total loss of the ticket price, unless the absence is due to force majeure or unforeseen circumstances duly documented and communicated through the Contact Form within 15 days of the scheduled travel date.

Category B – Non-resident workers, family members and caregivers (“working & parental”)
Maximum fares (without restrictions or inventory limits), applicable for both outbound and inbound travel, apply to non-residents:

  • ravelling to Sardinia for work purposes
  • having first-degree (parents and children), second-degree (grandparents and grandchildren), or third-degree family relationships, or marital or parental relationships with residents eligible for this fare
  • benefiting from leave under Law 104/92 to assist a relative resident in Sardinia
  • acting as legal guardian of a person resident in Sardinia

Category B fare includes

  • One cabin baggage up to 10 kg (55×40×25 cm)
  • One checked baggage up to 23 kg

Musical instruments and sports or technical equipment may also be included within the checked baggage allowance provided the total weight does not exceed 23 kg.

Fare rules – Category B

  • Only one ticket per passenger per day and per route (one-way) is allowed.
  • Flight and/or date changes are permitted without penalty up to 48 (forty-eight) hours before the scheduled departure time of the flight.
  • For requests made less than 48 (forty-eight) hours before departure, changes are permitted subject to payment of the applicable penalty. The cost of the date/flight change service is indicated in the “Taxes and Surcharges” table.
  • Route changes are permitted up to 48 (forty-eight) hours before the scheduled departure, exclusively through Customer Service. In such cases, any applicable fare difference may be charged.
  • Name changes are permitted up to 48 (forty-eight) hours before the scheduled departure. The cost of the name change service is indicated in the “Taxes and Surcharges” table.
  • Ticket refunds are permitted provided that the request is submitted through the dedicated Contact Form, together with appropriate documentation proving eligibility for the purchased fare category, no later than 48 (forty-eight) hours before the scheduled departure time of the flight.
  • Refunds are in any case not permitted if the original ticket date has been previously modified less than 48 hours before departure.

Infant and child fares
Children under 2 years of age (INF) travelling under any Territorial Continuity fare category travel free of charge, provided they do not occupy a seat.
Passengers aged between 2 and under 14 years, belonging to Category A or B, benefit from a 30% fare reduction.


Check-in
Passengers holding a Territorial Continuity fare ticket may perform online check-in via the airline’s website or mobile application from 48 hours up to 1 hour before the scheduled departure time.
Alternatively, passengers may purchase the airport check-in service, either during booking or after booking, online (website/app) or at the airport.
The cost of this service is indicated in the “Taxes and Surcharges” table.

Conditions for accessing Territorial Continuity fares
It is not permitted to purchase, within the same online transaction, tickets for passengers entitled to reduced fares together with passengers who are not entitled to such fares.
It is also not permitted to include different categories of eligible passengers within the same booking (for example: resident/equivalent and family member, or worker and family member). Separate bookings must therefore be made.
To access the discounted fare, the passenger must complete a self-declaration pursuant to Article 47 of Presidential Decree (D.P.R.) 445/2000, certifying the family relationship, assistance relationship, or work reason justifying travel to Sardinia.
The declaration must be printed, completed and presented at boarding, together with a valid identity document.
False declarations regarding eligibility for the discounted fare will result, in addition to notification to the competent authorities, in Aeroitalia having the right to request:

  • payment of the full public fare applicable to the route
  • a penalty of €500 for each ticket improperly used
     

4.2.2 Fares for flights operated under Sicily's Territorial Continuity regime.

The fares of flights operated under the Territorial Continuity regime apply to passengers residing in Sicily on the routes operated by Aeroitalia to and from Comiso – Rome Fiumicino and Comiso – Milan Linate, without any discrimination based on nationality.
 
The fare includes, for each passenger:

  • 1 piece of hand baggage (max 10 kg, dimensions 55x40x20 cm) + 1 small backpack, dimensions 40x30x20 cm
  • 1 piece of checked baggage (max 23 kg).

The airport check-in service is included. Online check-in is available starting from 24 hours before departure.
For INFANT passengers (up to 2 years old) no fare is applied if they do not occupy a seat.
 
The following categories of passengers residing in Sicily benefit from an additional reduction on the Territorial Continuity fare:

  • 30% for children aged between 2 and under 12 years old;
  • 10% for students, pensioners, or persons travelling for health reasons.

It is not possible to purchase, in a single online transaction, air tickets for passengers eligible for discounted fares together with passengers who do not meet such requirements (non-residents).
 
Mandatory documentation:
At the time of check-in or boarding, each passenger residing in Sicily must present a valid identity card showing residence in Sicily.
In the case of a discount for special categories (students, pensioners, travellers for health reasons), supporting documentation must be presented (student card, pension certificate, hospital booking, or hospital discharge note).
If the required documentation is not presented, the passenger will be required to purchase a new ticket at a non-subsidized fare in order to travel.
 
The Territorial Continuity fare for the Comiso – Rome Fiumicino and Comiso – Milan Linate routes is non-refundable.
Date changes are permitted up to 3 hours before departure and are free of charge. Name changes are permitted up to 3 hours before departure and are subject to the provisions of Art. 3.3.3.

4.2.3 Fares for Flights Operated under the Friuli-Venezia Giulia Territorial Continuity Scheme

The fares applicable to flights operated under the Territorial Continuity Scheme are available to passengers residing in the Friuli-Venezia Giulia Region on the route operated by Aeroitalia between Trieste and Milan Linate, without any discrimination based on nationality.

The fare includes, for each passenger, one carry-on bag (maximum 10 kg, dimensions 55x40x20 cm) and one personal item/backpack (dimensions 40x30x20 cm).

Airport check-in is included in the fare. Online check-in is available from 24 hours up to 3 hours before departure.

The discounted fares are reserved exclusively for passengers residing in the Friuli-Venezia Giulia Region.

It is not possible to purchase, within the same online transaction, tickets for passengers entitled to the discounted fare together with passengers who are not entitled to it.

Mandatory Documentation

At check-in or boarding, passengers must present a valid identity document proving their residence in the Friuli-Venezia Giulia Region.

If the required documentation is not presented, or if the eligibility requirements are not met, the passenger will lose the right to the discounted fare and will be required to purchase a new ticket at the fare applicable at the time of the request.

The Territorial Continuity fare on the Trieste–Milan Linate route and vice versa is non-refundable.

Date changes and name changes are permitted up to 3 hours before departure and are subject to the conditions set out in Article 3.3.3 of the General Conditions of Carriage.

No surcharges or fare supplements other than those permitted by applicable legislation shall be applied.

4.3 Taxes and Airport Charges

At the time of Booking, the Passenger must bear the taxes and airport charges required by the government, any other authority, or an airport operator. The passenger will be informed of the amount of taxes at the time of booking, which will be added to the fare. Government taxes are subject to continuous changes.

4.4 Supplements

Depending on the chosen purchase channel, a service fee (Ticketing Fee) may be applied, directly by the Carrier or its Authorized Agents.

4.5 Currency

Taxes, fares, and charges must be paid in the currency of the country of origin of the entire Itinerary, unless otherwise specified by Aeroitalia. Aeroitalia may, at its discretion, accept payment in a currency different from that of the country of origin of the journey.

4.6 Value Added Tax (VAT)

Fares for international travel are not subject to Value Added Tax (VAT). Prices and related supplements on domestic routes (domestic flights) are subject to VAT.

ARTICLE 5. SPECIAL ASSISTANCES

The transport of unaccompanied minors, Passengers with Reduced Mobility, sick passengers, and anyone else requiring specific assistance may be subject to particular procedures.
Passengers are advised to inform Aeroitalia by contacting Customer Service of their special needs and the type of assistance required at the time of booking. Aeroitalia will make every effort to meet special assistance requests made after booking or according to applicable regulations (Regulation EC No 1107/2006) and within 48 hours before departure, taking into account the notice period and the specific characteristics of the requested assistance.

5.1 Transport of Infants

For safety reasons, infants (aged between 8 days and 23 months) must sit on an adult's lap using an infant seat belt provided by the onboard staff. The infant does not pay the ticket price but only a fixed fee, which varies depending on the route. The cost for the service can be verified in the Fees and Supplements table.
Infants aged between 8 days and 1 month can travel only if they have a medical certificate issued 5 days before each flight, stating the birth date, confirming that the birth occurred without complications and that the infant is authorized to travel, with the doctor's stamp and signature.
In the absence of such documentation, Aeroitalia reserves the right to deny boarding to the infant in question and is relieved of any liability.
The service price can be verified in the Fees and Supplements table.

5.2 Reduced Mobility

Aeroitalia aims to offer maximum comfort and reduce any obstacles that may be posed to people with different mobility capabilities, both on board its aircraft and during various stages of the journey. The management of the reception and boarding procedures for PRM (Persons with Reduced Mobility) is handled by the airport operator, who centrally ensures adequate support and access to various areas, including boarding the aircraft with dedicated support. However, it is important to ensure that requests for such assistance reach Aeroitalia at least 48 hours before departure to provide the best possible support.

In accordance with Regulation (EC) No 1107/2006 and to offer disabled persons and persons with reduced mobility the opportunity to travel by air, Aeroitalia informs about the procedures and/or safety measures applied on board its aircraft.

In compliance with current safety regulations and standards, a maximum number of passengers with reduced mobility is provided on each flight, in addition to the prohibition of assigning seats in positions that obstruct emergency devices and evacuation procedures of the aircraft. Passengers with reduced mobility cannot be allocated seats at all aircraft positions marked as "emergency exits".

To ensure the best service, passengers with reduced mobility or needing special assistance at boarding must present themselves for check-in at least two hours before the flight's departure, must have a travel document, an Aeroitalia booking, and have requested the assistance service at least 48 hours before the booked flight's departure.

Aeroitalia allows the boarding of 1 guide dog in the cabin without any charge. It is required that the animal has all necessary documents and is equipped with a muzzle, and that these documents comply with the destination country's requirements. To bring a recognized assistance dog, you must present a certificate at boarding stating that the dog has been trained as an assistance dog.

5.3 Wheelchairs

Foldable wheelchairs accompanying the passenger will be transported at no additional cost beyond the normal baggage allowance.

5.4 Stretchers

The stretcher service is available on flights to and from Sardinia. The service request must be made exclusively through the Aeroitalia call center. The service is subject to availability.
It is recommended to request the service well in advance, at least 120 hours before the flight departure date (excluding holidays) by contacting the Aeroitalia Call Center.

The service is not covered by regulation EC1107/06.

5.5 Oxygen Therapy

The transport of passengers requiring oxygen therapy is not allowed on Aeroitalia flights.

5.6 Seat Assignment for Minors (6 – 12 years) and Persons with Reduced Mobility (PRM)

In line with the provisions of the Civil Aviation Authority's resolution of 16.07.2021, Aeroitalia undertakes to guarantee that children aged 2 to 12 years traveling with parents or at least one adult companion are assigned seats close to their parents or companion, at no additional cost, in specific areas of the aircraft, indicated during the booking process.
A similar guarantee is provided to disabled persons or persons with reduced mobility (PRM) who are assisted by a companion.
Seat assignment on board the aircraft for these categories will be carried out during airport check-in procedures, starting from 2 hours before the flight and up to 45 minutes before the departure time.

ARTICLE 6. CHECK-IN AND BOARDING

6.1 Online Check-in

Passengers are offered the possibility to check-in online on the Aeroitalia Website or via the app available on iOS and Android devices and to print or download the Boarding Pass. Online check-in is available from 24 hours up to 3 hours before the flight departure for tickets purchased with the Basic fare (bundle), and from 30 days up to 3 hours before the flight departure for tickets purchased with the Classic or Biz fare (bundle) and for all passengers who have purchased a seat regardless of the public fare purchased. Passengers who have purchased the Basic fare, thanks to the Early Check-in service, can complete online check-in from 7 days to 3 hours before departure.
Passengers on routes to and from Sardinia can check in online from 24 hours to 90 minutes before departure.

Some categories of passengers such as families with children without pre-assigned seats, passengers with disabilities or requiring assistance, passengers transporting pets, or unaccompanied minors can only check-in at the airport. The service will be free of charge.

6.2 Airport Check-in and Boarding

Unless the booking includes the Plus or Biz fare (bundle), if online check-in is not completed within three hours before the scheduled departure time, you will be charged the airport check-in fee indicated in the Fees and Supplements table.

6.2.1 Check-in Deadline

The check-in deadline varies from one airport to another.
Aeroitalia starts check-in operations 3 hours before the flight departure until 40 minutes before departure.
The passenger must strictly adhere to the deadlines, otherwise, the bookings will be canceled. The carrier or the authorized agent will provide the passenger with the necessary information on check-in deadlines.
The check-in deadline indications are in any case an integral part of the transport contract.

The Passenger must arrive well in advance of the flight departure to complete all the necessary formalities for the trip and, in any case, within the Check-in Deadline. If the Passenger does not have all the necessary documents for check-in, the Carrier may cancel the booking without any liability towards the Passenger.

The Passenger must also arrive at the boarding gate before the boarding time indicated at check-in and on the Boarding Pass. The Carrier may cancel the Passenger's booking, without any liability towards the Passenger, if they do not arrive at the boarding gate within the indicated time.

Boarding at the indicated gate will be possible up to 20 minutes before the flight departure.

Aeroitalia is not responsible for any costs or expenses incurred by the Passenger who has not complied with the provisions of this article.

6.2.2. Code of Conduct

Any form of abusive and aggressive behavior towards airport ground staff, Company staff, and other passengers is strictly prohibited. Any form of verbal and/or physical aggression will not be tolerated. Our staff will also report such behavior to Airport and Police Authorities for appropriate actions. It is also forbidden to check in baggage for third parties and to take delivery of objects, envelopes, suitcases, and bags from other passengers.

6.3 Security Checks

All departing passengers are subject to a security check before accessing the boarding area.

To avoid delays during the boarding operations of your flight, Aeroitalia strongly advises its passengers to proceed to these checks without any delay from the moment they complete their check-in. During these checks, it is necessary to cooperate with the airport staff and place the following items in the appropriate tray: lighters, belts, mobile phones, credit cards, wallets, keys, watches, bracelets, rings, jackets with zippers and buttons.

If the Metal Detector indicates the presence of metal parts, you may be asked to repeat the checks or to open your hand luggage for a manual inspection.

Passengers carrying pacemakers or metal prostheses - if they prefer not to pass through the Metal Detector - can notify the carrier and airport security staff, who will proceed with a manual check of these passengers, making them pass through a dedicated lane. It is essential to have a medical certificate attesting to the disability.

6.4 Connecting Flights

Aeroitalia does not guarantee connections with flights operated by other carriers or other means of transport, except for those sold by Aeroitalia.

Any other connecting flight performed outside the above rule will be the passenger's total responsibility and may require check-in for each connecting flight.

In the case of connecting Aeroitalia flights, the passenger must notify the entire journey at check-in; in this case, the passenger will be informed about the boarding passes and baggage tags for subsequent flights.

6.5 Documents Required for Travel

For check-in, you must report to the registration desks with an identity document valid for your travel destination, accompanied by all other documents required by customs and immigration authorities of the destination country.

Additionally, before departure, it is advisable to verify whether an entry visa is required for your destination country.

For domestic travel, presenting one of the identification documents specified in Article 35, paragraph 2, of the Presidential Decree no. 445 of December 28, 2000, is sufficient ("Equivalent to an identity card are the passport, driver's license, boating license, pension card, thermal plant operation license, gun license, or any other photo ID card issued by a State administration with a seal or equivalent marker").

Passengers are required to carefully check the necessary documents for their journey, as these requirements may vary over time and/or may differ depending on the type of traveler (adult, minor, nationality, etc.). Failure to meet even one of the above requirements may allow the carrier to deny boarding to the passenger, without any entitlement for the latter to claim compensation for damages and/or incurred costs.

Digital photographs or photocopies of travel documents are not accepted for travel on Aeroitalia flights. The original physical documents, such as the identity card or passport, must be presented at check-in and boarding. This requirement applies to both domestic and international flights.

Any fines imposed on the carrier for irregular travel documents will be the responsibility of the passenger.

The verification of the documents required for travel to non-EU countries (passport, entry visas, customs formalities, etc.) is the responsibility of the passenger. Information on travel documents is available on the websites of the State Police (www.poliziadistato.it), the Ministry of Foreign Affairs (www.viaggiaresicuri.it), and at the embassies or consular offices of individual countries.

6.5.1 Pregnant Women

Aeroitalia accepts passengers with a single pregnancy up to 36 weeks and for multiple pregnancies up to 28 weeks. From the 28th week to the 34th, a medical certificate with the following information is required:

  • whether the pregnancy has had a normal course
  • the expected date of delivery
  • whether the woman is in good health and fit to fly
  • that there are no known reasons why she should not fly

In the absence of a medical certificate, Aeroitalia, in particular circumstances and always prioritizing the passenger's safety, reserves the right not to accept the woman. Before undertaking a trip during pregnancy, it is advisable to consult your doctor about any travel restrictions.

If the passenger is expecting a single baby, without complications, she cannot travel by air after 36 weeks of pregnancy.

If the passenger is expecting multiple babies, without complications, she cannot travel by air after 32 weeks of pregnancy.

A passenger can fly 48 hours after delivery, provided the birth was without complications and no surgical interventions were involved. In the case of a cesarean delivery or if the mother has undergone surgery, the minimum period before being able to travel is 10 days, if she has a medical certificate attesting her fitness to travel.

6.5.2 Unaccompanied Minors

For passengers aged between 6 and 14 years (18 years for minors of non-Italian nationality) who are departing for national and international destinations and traveling alone or with a minor escort, the "Unaccompanied Minor" service is mandatory.
Minor passengers traveling alone and who are beyond the age to use the mandatory service can request the "Voluntary Unaccompanied Minor" service.

The mandatory accompaniment service for minors under 14 years (18 years for minors of non-Italian nationality) must be requested  must be requested using the appropriate form, printed and completed in triplicate [download here]. The minor must present themselves at the check-in counter 2 hours before departure, accompanied by an adult.

The service is limited; therefore, it is necessary to verify availability before proceeding with the booking. To check availability and book the service, please contact our Call Center at least 48 hours before departure. The supplement must be paid at the time of booking.
You will need to provide the personal details of the person accompanying the minor to the departure airport and the person picking them up at the arrival airport.
The cost of the service can be checked in the Taxes and Supplements table.
Service availability is limited to a maximum of 4 unaccompanied minors per Aeroitalia flight, with no more than 2 under the age of 10.

Aeroitalia does not accept unaccompanied minors on transit/connecting flights.

It is necessary to present at the Aeroitalia check-in counters at the departure airport at least 2 hours before the scheduled departure time, presenting the completed form sent to the company when requesting the service. The minors will be welcomed at check-in by ground staff and, with the airport staff, will be accompanied to boarding and then entrusted to the cabin manager who will take care of them for the entire flight duration. The person accompanying the child at departure must remain at the airport for 30 minutes after the aircraft's takeoff so that, in the event of flight cancellation, they can take the child home. Upon arrival at the destination airport, airport staff will again take care of the minor until delivery to parents or designated relatives in the arrival area. The UMNR transport service is always subject to reconfirmation by the Company before departure.

It is the parents' responsibility to verify the validity of all necessary documents and authorizations for the unaccompanied minor's transport from the country of origin to the flight destination. Whenever an Italian minor under 14 years old travels outside national territory, unaccompanied by a parent or guardian, an Accompaniment Declaration issued by the Police Headquarters is required, indicating the name of the person or entity (e.g., the airline) to whom the minor is entrusted, signed by the person exercising parental authority and endorsed by the authorities responsible for issuing the passport in the applicant's residence jurisdiction.

The application of the above regulation for Italian minors is also extended to all minors holding dual passports (Italian and foreign) as Italian law on child protection applies. In all cases of absence and/or irregularity of the aforementioned form, the minor's boarding will be denied.

The Company assumes no responsibility in case of denied boarding due to inadequate and/or insufficient documentation.

All information on the requirements for minors' expatriation is available on the State Police website under the "Minors Expatriation" section.

6.6 What is allowed to bring on board

Always referring to the service included in the purchased fare, it is allowed to bring:

  • a small carry-on bag, with a maximum weight of 10 kg and dimensions 40x30x20 cm, which must be placed under the seat in front of the passenger;
  • a large carry-on bag (trolley) with a maximum weight of 10 kg and dimensions 55x40x20 cm; the cabin trolley will be placed in a closed overhead bin reserved for passengers.

Unchecked baggage must comply with the carrier's further regulations. The passenger must follow all instructions and guidelines provided by the carrier regarding the baggage transported in the cabin by the passenger. The Carrier reserves the right not to admit certain baggage in the cabin and to consider it as checked baggage. Infants do not have a cabin baggage allowance; Aeroitalia allows the transport of food and necessary items exclusively for the journey in the cabin for up to 2 kg. The transport of auxiliary seats for infants or children under 5 years is not allowed. Additionally, the passenger is allowed, unless otherwise restricted by the airline, to bring additional items on board, such as:

  • overcoat or raincoat
  • umbrella
  • crutches or other walking aids
  • items purchased at "duty-free" shops and commercial establishments within the airport and on aircraft
  • medicinal liquids/solids essential for personal medical, therapeutic, and dietary purposes necessary for the duration of the trip (and which due to their nature or size cannot be transported in hand luggage) upon presentation at the check-in counters and security checks of a medical certificate, issued within the last 3 months, attesting to their necessity;
  • liquids within allowed limits.

Passengers are not allowed to transport the following items in their checked baggage:

  • ammunition
  • detonators and fuses
  • detonators and cords
  • mines, grenades, and other military explosive materials
  • smoke canisters and cartridges
  • dynamite, gunpowder, and plastic explosives
  • pepper spray for personal defense
  • components of fuel systems that have contained fuel
  • alarm devices
  • gas, including propane and butane
  • flammable liquids, including gasoline and methanol
  • cooling and irritating liquids
  • radioactive material, including medical or commercial isotopes
  • flammable solids and reactive substances, including magnesium, ignition devices, pyrotechnic articles, and rockets
  • corrosive substances, including mercury and vehicle batteries
  • flammable liquids/solids, including alcohol over 70 degrees
  • magnetizing substances
  • oxidizing substances and organic peroxides, including bleach and car body repair kits
  • toxic or infectious substances, including rat poison and infected blood
  • underwater torch with batteries inserted

In some airports, it is temporarily possible to carry only LAGs (Liquids, Aerosols, and Gels) exempt from control, namely:

  • LAGs in containers with a capacity not exceeding 100 ml or equivalent inserted in a clear, resealable plastic bag with a capacity not exceeding one liter, where the contents fit comfortably and the bag is completely closed;
  • LAGs to be used during the journey for medical purposes (accompanied by a medical prescription) or for a special dietary regime (including baby food) in containers with a capacity not exceeding 100 ml or equivalent.

6.7 At the Airport

To facilitate checks, it is mandatory to:

  • present all LAGs carried as hand luggage to the security staff for examination
  • remove jackets and overcoats: they will be inspected separately
  • remove laptops and other large electrical and electronic devices from hand luggage to allow for separate inspection of these items from hand luggage.

LAGs (Liquids, Aerosols, and Gels) include:

  • water and other drinks, soups, syrups
  • creams, lotions, and oils
  • perfumes
  • sprays
  • gels, including hair and shower gels
  • contents of pressurized containers, including shaving foam, other foams, and deodorants
  • pastes, including toothpaste
  • mixtures of liquids and solids
  • any other product of similar consistency

ARTICLE 7. REFUSAL OF TRANSPORT

Should one or more of the following circumstances occur or be likely to occur on any flight operated by Aeroitalia, the Air Transport of the Passenger and/or their Baggage may be denied:

  1. If it is deemed necessary for compliance with laws, regulations, or rules of any State of departure, destination, or overflight, including expressly those concerning the Covid-19 pandemic, as well as the sanctioning provisions established by the United Nations, the United States of America, the United Kingdom, the European Union, and/or any other State (or international organization) whose regulations are relevant for Air Transport;
  2. If it is deemed necessary in response to a written request from the Authorities of the Country of departure, transit, or destination;
  3. If the transport of the Passenger or their Baggage may pose a threat to the safety, health, or tranquility of other passengers or crew members;
  4. If the passenger's physical or mental state, even due to the consumption of alcohol or the use of drugs or medications, may constitute a danger or risk to themselves, other Passengers, the crew, or property on board;
  5. If the passenger has exhibited unacceptable behavior on a previous flight and we have good reasons to believe it may happen again;
  6. If the passenger has refused to undergo security checks;
  7. If the passenger has not paid a due fare, tax, or supplement;
  8. If the passenger does not possess valid travel documents;
  9. If the passenger has not complied with the requirements of these General Conditions of Carriage (G.C.T.) or the Fare Rules for the use of the Ticket and/or the boarding of Baggage and accompanying animals.

If air transport is refused for any of the reasons listed above, or if the passenger is removed from the aircraft, Aeroitalia may, at its discretion, refund the price paid by the Passenger for the unused segment. Aeroitalia will not be held responsible for any losses, damages, deaths, or physical injuries resulting from the refusal to transport the passenger or their baggage, under the circumstances justifying Aeroitalia's refusal of transport as indicated above.

ARTICLE 8. BAGGAGE

8.1 Passenger Obligations

The Passenger declares to be thoroughly aware of the contents of each of their Baggage and undertakes not to leave their baggage unattended from the moment of preparation. The passenger also undertakes not to carry baggage entrusted to them by third parties. It is the passenger's responsibility to ensure that their baggage is correctly and securely packed and protected by suitable containers.

8.2 Baggage Allowance and Excess Baggage

Based on the applicable fare, a limited number of baggage items can be checked as part of the baggage allowance. The baggage allowance is indicated on the ticket and can be requested from the carrier or the authorized agent who issued the ticket. The transport of baggage exceeding the baggage allowance and special baggage is subject to the payment of a supplement. For the costs applied to extra baggage, refer to the Fees and Supplements table.

8.3 Checked Baggage

Referring to the service included in the purchased fare or the services added separately to a booking, it is permitted to carry checked baggage with a weight of 23kg (unless different contractual indications are verified in the case of charter flights), and dimensions of 80x50x30 cm.

Each passenger can purchase up to 4 checked baggage items of 23 kg each. Baggage exceeding 23kg can be transported after paying the excess baggage fee indicated in the Fees and Supplements table.
Baggage weighing more than 32 kg is not permitted in the hold.
Infants and children up to 5 years old are entitled to free transport of a stroller in the hold.

The Passenger can hand over their baggage at the Carrier's check-in counter before the check-in deadline. The Carrier will assume custody and issue the Passenger a baggage receipt for each checked baggage.
Checked baggage must be correctly packed to protect its contents and withstand normal handling. According to current regulations, passengers are advised not to include money, jewelry, or valuable items, identification documents, and electronic devices in their baggage.

For passengers who have not purchased the priority boarding service, at the gate, the large carry-on bag will be taken, tagged, and sent to the aircraft hold for a service fee. The cost can be verified in the Fees and Supplements table. This process will be accompanied by issuing a baggage tag to ensure the baggage is correctly returned to the owner upon arrival. Passengers are strongly advised to ensure that all valuable or personal items are removed from the carry-on bag before handing it over.

8.4 Labels to be affixed to checked baggage

Aeroitalia requires checked baggage to be identified with a personal name tag that includes name, surname, address, and phone number.

It is important to always remove any tags related to previous trips from your baggage. Correct identification of suitcases through your personal tag helps airport staff in case of loss or misrouting of the baggage.

Checked baggage is transported on the same aircraft as the Passenger, unless there are safety or operational reasons requiring transport on a subsequent flight.

8.5 SPECIAL EQUIPMENT

8.5.1 Sports Equipment

  • Sports equipment is subject to the same travel conditions as checked baggage; however, some special types are subject to a supplemental fee per segment, see the Fees and Supplements table.
  • Hang gliders and paragliders, poles, or other bulky sports equipment are not allowed on flights operated by ATR, E145, or similar aircraft.
  • A limited number of surfboards are allowed, subject to flight availability and request to our call center.
  • The maximum dimensions for sports equipment are 250 cm in length x width x height, unless otherwise specified in the relevant description.
  • For flights operated by ATR or E145, the dimensions are 158 cm linear. On E145 aircraft, sports equipment exceeding these measures can be evaluated.
  • In some countries, prices may be subject to additional tax surcharges.
  1. Fishing Equipment
        Fishing equipment consists of rods, reels, a net for storing fish, a pair of fishing boots, and a tackle box.
        Dimensions: 158 cm length
  2. Golf Equipment
        Golf equipment consists of 1 golf bag containing golf clubs and 1 pair of golf shoes.
  3. Alpine Ski Equipment
        One pair of snow skis, one pair of poles, and one pair of ski boots.
  4. Snowboard Equipment
        One snowboard and one pair of boots.
  5. Water Ski Equipment
        One pair of standard water skis or one slalom ski.
        Weight: 23 kg. The excess baggage fee may be charged for excess weight.
        Dimensions: 158 cm (sum of 3 dimensions).
  6. Kayak Equipment
        Canoe and paddles measuring 4.90 m.
  7. Hockey or Lacrosse Equipment
    • One duffel bag containing hockey or lacrosse equipment.
    • Two hockey or lacrosse sticks tied together for each passenger.
          Weight: 23 kg. The excess baggage fee may be charged for excess weight.
          Dimensions: 158 cm (sum of 3 dimensions).
  8. SCUBA Diving Equipment
    SCUBA diving equipment may consist of: wetsuit, jacket, boots, mask, shoes, torch, nets, knife, 1 empty oxygen cylinder, and 1 temperature regulator. For acceptance, it is necessary:
    • to present the empty compressed air cylinder at the check-in counter.
    • To remove the bulb from the torch and pack it separately.
  9. Surfing Equipment
        Windsurfing: Equipment may consist of one surfboard, one mast, one sail, and one boom.
        Surfing: One surfboard
        Kitesurfing: one kite, one bar, and one board.
  10. Sporting Firearms
        The transport of sporting firearms is regulated by the following regulatory references: PNS ed. 2 amendment 1 - Law 694/74. The costs and conditions of transport of firearms (WEAP) apply.
        Anything not listed is considered excess baggage. For costs, please check the Fees and Supplements table.

8.5.2 Bicycles

Each bicycle will be transported individually (including trailers or accessories of similar size). For acceptance, the passenger must present the bicycle at the check-in counter with:

  • The handlebar turned lengthwise.
  • Pedals removed
  • Extendable parts removed or covered.
  • Deflated tires (the front wheel must be removed and attached to the frame).
  • Properly packed in a bag or box

8.5.3 Musical Instruments

Musical instruments can be transported for free instead of carry-on baggage, provided their dimensions do not exceed 55 cm x 40 cm x 20 cm or the maximum weight of 10 kg. If the passenger wishes to bring the musical instrument in the cabin in addition to carry-on baggage, they must purchase the Musical Instrument service at a cost of 50 euros/segment. If the instrument exceeds the above limits, it can be transported as special cabin baggage by purchasing an additional ticket or as checked baggage by paying the fee indicated in the Fees and Supplements table. The service can be booked through Aeroitalia Customer Service.

8.5.4 Special Cabin Baggage

If, due to its size or weight, the baggage cannot be stored in the overhead bins or under the seat and the passenger wishes to keep it under their custody, it will be transported occupying one or more additional seats.
The cost of this seat will be the available ticket price at the time of purchase, excluding airport taxes. Special baggage must not exceed 75 kg (165 lb) per booked seat and must respect the following volume limitations, depending on the type of aircraft operating on these routes. If these limitations are exceeded, the baggage must be transported in the hold.
The baggage must be packed in a way that allows it to be secured to the seat and placed in a window position; seats near the emergency exits cannot be used.
The passenger who requests the use of one or more cabin seats for the transport of baggage (CBBG) does not have extra baggage allowance for the additional purchased seat; according to IATA Circular No. 720, Annex "C".

Requests should be made by contacting Aeroitalia Customer Service, either through the contact form or the call center.

8.5.5 Special Baggage in the Hold

Musical instruments can be transported for free in place of one of the registered suitcases included in the allowance, under the passenger's sole responsibility, provided they do not exceed the maximum permitted dimensions and weight (158 cm total for height, length, and width) and 23 kg. If the flight allows the purchase of excess baggage and payment is made in advance, the maximum weight of the instrument will be increased to 32 kg.

8.6 Prohibited Items

The transport of the following items is not permitted:

  • Items that may endanger the aircraft, people, or objects on board, as specified in the ICAO or IATA Dangerous Goods Regulations. The list of such items can be requested from the carrier or the Authorized Agent who issued the ticket. These include explosives, compressed gases, oxidizing materials, radioactive or magnetic materials, easily flammable materials, and poisonous or aggressive substances;
  • Items whose transport is prohibited by the laws, regulations, or orders in force in any country from which the flight departs, arrives, or transits;
  • Dangerous, unsafe, or inappropriate items for transport due to their weight, size, or type, or because they are fragile, perishable, or particularly delicate;
  • Lithium or rechargeable lithium batteries (commonly used in consumer electronics such as laptops, computers, cell phones, watches, and cameras) can only be transported in carry-on baggage. A maximum of two spare lithium or rechargeable lithium batteries with a power not exceeding 160 Wh can be transported as spare batteries for consumer electronics. The transport of separate lithium or lithium batteries with a power between 100 Wh and 160 Wh must be approved in advance by the airline.
  • Weapons of any kind, especially firearms, cutting or pointed weapons, and sprays. Sporting weapons may be accepted as baggage at our discretion. They must be unloaded and secured. The transport of ammunition is subject to ICAO and IATA regulations.
  • Items that are unsuitable for transport due to their weight, size, shape, or nature, particularly considering the type of aircraft used.
  • Information about such items will be provided to Passengers upon request.

Aeroitalia is not responsible for items deliberately placed in checked baggage in violation of the provisions of this paragraph. Aeroitalia reserves the right to refuse the acceptance for transport, or to refuse the continuation of transport if already accepted, of any item deemed unsuitable for the reasons listed above.

8.6.1 Electronic Devices and Batteries

The possibility of transporting lithium batteries on an aircraft depends on their watt-hour (Wh) capacity (for rechargeable lithium-ion batteries) or the lithium content in grams (for non-rechargeable lithium metal batteries).

When carrying electronic devices such as watches, calculators, cameras, mobile phones, laptops, camcorders, and other devices containing lithium or lithium-ion batteries, spare batteries must be individually protected to prevent short circuits (by placing them in their original packaging or isolating the terminals, e.g., covering exposed terminals with tape or placing each battery in a plastic bag or protective pouch). These batteries can only be carried in carry-on luggage.

Do not place spare batteries in checked baggage!

Additionally, each installed or spare battery must not exceed the following limits:

  • Lithium metal or lithium alloy batteries must not contain more than 2 grams of lithium.
  • Lithium-ion batteries must not exceed a capacity of 100 Wh.
  • Lithium-ion batteries with a capacity greater than 100 Wh but not exceeding 160 Wh can be carried as spare batteries or within the equipment only in carry-on luggage, subject to airline approval.
  • Each passenger may carry a maximum of two (2) individually protected spare batteries with a capacity between 100 and 160 Wh.

8.7 Unchecked Baggage

Referring to the service included in the purchased fare, it is permitted to carry:

  • A small carry-on bag with a maximum weight of 10 kg and dimensions of 40x30x20 cm, which must be placed under the seat in front of the passenger;
  • A large carry-on bag (trolley) with a maximum weight of 10 kg and dimensions of 55x40x20 cm; the cabin trolley must be placed in a closed overhead bin reserved for passengers.

Each ticket allows for the transport of unchecked baggage in limited quantities by number and/or weight and/or size.
Unchecked baggage must be of such dimensions that it can be placed under the seat in front of the passenger or in the overhead bins.
The need for the carrier to check a baggage item for transport in the hold due to the passenger's failure to comply with these conditions may result in the passenger paying a supplementary fee if the baggage exceeds the allowed limit.
At any time before the flight's departure, for safety or aircraft operational reasons, the Carrier may refuse the boarding of baggage that must be checked as registered baggage, without any supplementary fee.

8.8 Right to Inspect

For safety and/or security reasons and/or at the request of authorities, the passenger may be asked to cooperate in the search or inspection via X-ray or other means of their baggage. In the passenger's absence, their baggage may be inspected or searched, particularly to check if it contains the items referred to in Article 8.6 above.

The carrier may refuse to transport the Passenger who does not comply with such requests.

8.9 Retrieval and Delivery of Baggage

It is mandatory to retrieve checked baggage as soon as it is available upon arrival. Checked baggage not claimed within three (3) months from the moment it is available for retrieval may be disposed of without any liability to the passenger-owner.
If a person requests the delivery of checked baggage but cannot present the baggage receipt and identify the baggage with the appropriate identification tag, if issued, we will deliver the baggage to this person only if they can reasonably prove their right to it.
Acceptance of baggage by the holder of the receipt, who makes no complaint at the time of delivery, constitutes a presumption, unless proven otherwise, that the baggage has been delivered in good condition and in accordance with the transport contract.

8.10 Companion Animals and Service Dogs

The transport of pets accompanying the Passenger is subject to prior and explicit acceptance by the Carrier.
Aeroitalia's directives comply with animal protection regulations, entry and exit regulations, and IATA (International Air Transport Association) regulations in force. The pets accepted on Aeroitalia flights are: dogs, cats, small rodents, domestic rabbits, ferrets.

The current regulations prohibit the transport of some categories of pets. Information on these categories is available upon request from the carrier or its authorized agents. The Passenger is required to inform themselves in advance and before booking the flight about the entry and exit regulations in force for the animal in the country of departure, transit, and arrival. The carrier assumes no responsibility for the refusal of animals without the necessary and required documentation. Any fines are the responsibility of the passenger/owner. Furthermore, Aeroitalia reserves the right to apply stricter rules and to refuse reservations on certain routes, denying the possibility of traveling with animals. Each passenger can transport a maximum of one (1) animal (in an authorized carrier). The transport can only take place in the passenger cabin.

To travel on Aeroitalia flights, the companion animal must have:

  • Passport (for international flights) or health booklet (for domestic flights) issued by a veterinarian, showing vaccinations (mandatory updated and valid rabies vaccine for international flights) and the animal's health status.
  • Microchip (for international flights).
  • The minimum age is 12 weeks.

8.10.1 The Carrier

The maximum dimensions of the carrier are 46x31x25 cm. The containers must comply with the IATA Live Animal Regulations (LAR).

  1. The total weight of the carrier, including the animal, must not exceed 10 kg.
  2. With the carrier closed, the animal must be able to assume its natural position, turn around, and crouch without difficulty.
  3. The carrier must be securely closed, watertight, and bite-proof.
  4. The inside of the carrier must be lined with absorbent material.

Once on board, the carrier with the animal inside must be placed under the front seat. If this is not possible, the animal must be secured with a leash to the owner's seat belt and remain inside the carrier.

Each passenger can bring one carrier into the cabin. The number of animals per carrier is limited to one. However, there are exceptions: two puppies of similar size, same species, and a minimum age of 12 weeks, or two adult animals of similar size and same species, or a mother with a dependent puppy (0-6 weeks) are allowed in the same carrier. Multiple animals can be transported in the same carrier as long as all inside can assume a natural position, turn around, and crouch without difficulty, get along with each other, and the total weight of all animals does not exceed 10 kg, including the carrier.

Aeroitalia accepts a maximum of 6 PETC in the cabin on each flight.

If Aeroitalia is forced to deny the transport of the animal due to non-compliance with the provisions, the company is not responsible for the resulting costs (e.g., rebooking fees, hotel stays, and animal boarding fees). Aeroitalia cares about the safety and well-being of all passengers, and this also applies to animals.

8.10.2 Guide and Assistance Dogs

Aeroitalia allows the transport of guide and assistance dogs on board aircraft. The service is free and subject to the conditions for transporting animals in the cabin.

We consider the following dogs as assistance dogs, provided they have documentation certifying this status:

  • Guide dogs that provide assistance to people with a visual deficit or disability.
  • Guide dogs that provide assistance to people with physical disabilities.
  • Hearing dogs that provide assistance to people with hearing impairments by alerting them to certain sounds and their sources.
  • Medical alert dogs that provide assistance to people suffering from diabetes, epilepsy, or other conditions that cause seizures with loss of consciousness and sensory alterations.
  • Dogs that provide assistance to people with autism spectrum disorders.
  • Rescue dogs that have completed training to collaborate and assist State Security Forces and Corps, accompanying a rescue team, with the appropriate harnesses and traveling without occupying a seat.
  • Dogs in training with a sufficient level of training to complete the flight while maintaining appropriate behavior, provided they are accompanied by their trainer and have an original certificate issued by the training institution they serve.

The dog must present a training certificate in which the canine center/institute of reference certifies on letterhead (or with a readable stamp) that it is a service dog. The dog must wear the appropriate harness. Assistance dogs are not subject to limitations. The service must be requested at least 48 hours before the flight's departure to our Customer Service and will be confirmed after verification of all submitted documentation.
To ensure a smooth and safe flight, the guide or assistance dog must be accustomed to obeying and behaving appropriately in public places (e.g., not barking, growling, or jumping on people or other animals). If the dog does not behave appropriately, Aeroitalia may refuse the transport of the animal. The damage and additional costs caused by the transport of the dog are entirely the responsibility of the Passenger.
The Passenger will bear all costs resulting from non-compliance with these obligations, as well as all damages caused by the transported animal and exempts the Carrier from any responsibility and consequences arising from the failure to verify the conditions and/or limitations mentioned above and the lack of necessary documents and/or failure to comply with applicable laws and regulations.

Dogs that offer emotional support are not considered trained assistance dogs and therefore their transport is not provided free of charge on our flights. Their transport is possible for a fee according to the procedures for boarding dogs in the cabin.
 

ARTICLE 9. TRANSPORT OF WEAPONS

The transport of weapons is allowed according to Italian law; therefore, passengers wishing to board a weapon must have a valid weapon permit and report the weapon.

Weapons can only be transported in the hold; they must be disassembled, properly packed, and separated from the ammunition.

Ammunition can be transported according to the international ICAO regulations, based on the instructions for the transport of dangerous goods and in accordance with IATA regulations for the transport of weapons and ammunition.

Weapons and ammunition must be declared at check-in.

IATA regulations stipulate that a passenger cannot transport more than 5 kg of ammunition per flight.

The transport of weapons is subject to an additional fee, which can be verified by booking online or by contacting the call center or an authorized agent.
 

9.1 Exceptions only on Italian territory.

The transport of weapons in the cabin is allowed for the following Italian subjects, only if they have a valid identification document; it is authorized by law no. 694 of December 23, 1974:

  • Chief of Police;
  • Police Inspectors and Assistants;
  • Provincial Administrative Inspectors;
  • Public Security Officials;
  • Members of the Carabinieri;
  • Members of the State Police Corps;
  • Members of the Guardia di Finanza;
  • Members of the State Forestry Corps;
  • Members of the Custody Agents Corps;
  • Officers, Non-commissioned Officers, and Soldiers of the State Armed Forces, with appropriate documentation certifying that the person is traveling for service reasons;
  • Prefects;
  • Deputy Prefects;
  • Pretors;
  • Magistrates assigned to the Public Prosecutor's Office or the Instruction Office (GIP).

The transport of weapons for the aforementioned categories is not permitted on Aeroitalia flights operated by Fly Air41 Airways.

ARTICLE 10. TRANSPORT OF REMAINS AND CREMATION URNS

The transport of ashes in the appropriate urn is possible both in the hold and in the cabin and follows the rules of checked baggage or cabin baggage.

The transport of remains is a service guaranteed through cargo. For information, please contact Customer Service.

ARTICLE 11. SCHEDULES, DELAYS, OR CANCELLATIONS

The scheduled flight times can be consulted on the Aeroitalia website and are communicated during the booking process, as well as reported on the booking and purchase receipt. The carrier will do everything in its power to transport the passenger and their luggage to the destination without delays. However, the regularity and punctuality of flights are subject to a series of factors independent of the carrier itself and that may result in the rescheduling or cancellation of the flight. The carrier undertakes to inform passengers of any changes to flights as soon as possible and will do everything in its power to alleviate the inconveniences of its passengers.

The passenger is required to provide their contact details at the time of booking, where communications regarding any changes to flights can be sent.

In the event that Aeroitalia is not aware of the customers' contacts for reasons not attributable to the carrier itself, it will not be responsible for the failure to communicate any delays or cancellations, including cases where third parties are informed.

In case of delay, cancellation, or denied boarding due to overbooking, Aeroitalia will apply the mandatory international, European, and national regulations in force, in particular Regulation (EC) No. 261/2004 of the European Parliament and Council of February 11, 2004, which can be consulted on the Aeroitalia website.

If, for reasons beyond the control of the Carrier (e.g., adverse weather conditions), it is not reasonably possible or prudent to land at the original destination airport and it is appropriate to land at another airport, the air transport will be considered completed when the aircraft arrives at the other airport, unless the aircraft then proceeds to the original destination. The carrier will still organize alternative transport, including with other means of transport, if necessary, to transport passengers to the original destination without additional costs.

In the event that the air carrier is required, for various reasons, to change the flight schedule by more than 3 (three) hours compared to the original schedule, and such change is communicated more than 14 days prior to the original departure date, passengers holding valid tickets for the affected flight will be offered the option to choose between:

  • rebooking on an alternative flight, under comparable transport conditions, to the final destination. Passengers may choose to board another flight operated by Aeroitalia on the same route, subject to seat availability. This change must be made no later than 3 hours before the departure time of the new flight; or
  • a refund of the full ticket price at the original purchase price, for the part or parts of the journey not taken. The refund request must be submitted no later than 24 (twenty-four) hours before the new scheduled departure time.

If the passenger does not choose any of the above options within the specified time frame, it will be deemed that they accept the change to the new scheduled time without any further claims.

In the event that the air carrier is required, for various reasons, to change the flight schedule by an advance or delay between 1 (one) and 3 (three) hours, and such change is communicated more than 14 days prior to the original departure date, passengers will be allowed to change their booking free of charge to another Aeroitalia flight on the same route, without penalties, but subject to any applicable fare difference based on availability.
Such modification must be requested no later than 3 hours before the new scheduled departure time by contacting Aeroitalia Customer Service.

In the event that the airline is forced, for various reasons, to delay the departure of a flight by more than 5 (five) hours compared to the original schedule, passengers holding valid travel tickets for the affected flight are offered the option to choose between:

  1. modifying their booking to an alternative flight, under comparable transport conditions, to the final destination. Passengers may opt for boarding another flight operated by Aeroitalia on the same route; or
  2. receiving a full refund of the ticket price for the unused part(s) of the journey.

ARTICLE 12. REFUNDS

12.1 General

The full or partial refund of a ticket will be made as outlined below, in accordance with the fare conditions of the purchased fare and the applicable regulations. If Aeroitalia is unable to fulfill its travel obligations, it will refund the purchased fare as indicated below:

  1. full refund of the purchased fare, in the event that no alternative flight is bookable following a cancellation;
  2. if the flight cancellation occurs after the journey has commenced, the refund will cover the fare portion for the unflown segment.

The refund will be made in the same form of payment used for the initial purchase and in the name of the booking holder; or upon presentation of an identity document, in the name of the person who made the original purchase. Ancillary services are non-refundable.

12.2. Refund for involuntary withdrawal from transport

In the event of involuntary withdrawal from transport by the passenger, the latter may claim the rights provided for by European Regulation (EC) 261/2004.

12.3. Refund for voluntary withdrawal from transport

By purchasing the travel ticket, the passenger acknowledges that tickets issued by Aeroitalia are considered non-refundable under any circumstances, except for the cases provided in Article 12.2 of these Terms and Conditions. In the event of voluntary withdrawal from transport by the passenger, no refund of the ticket fare will be granted, including for personal schedule changes or travel plan modifications.
However, airport taxes and fees not used remain refundable upon passenger request, as provided by applicable law. The passenger may submit a refund request using the form available on the official Aeroitalia website. It is the passenger’s responsibility to ensure that flight details are correct at the time of purchase.

ARTICLE 13. ADDITIONAL SERVICES

Aeroitalia assumes no obligation (nor any liability) in relation to services other than air transport provided by third parties, even if such services are advertised and purchasable on the Aeroitalia website. These services are managed by such third parties and are subject to the terms and conditions of the service provider.

ARTICLE 14. ADMINISTRATIVE FORMALITIES

14.1 General Terms

The Passenger is required, under their sole responsibility, to obtain all necessary travel documents and visas and to comply with all regulations of the States from which they depart, in which they arrive, and through which they transit; this obligation also applies to the regulations and instructions issued by Aeroitalia from time to time in this regard. The travel documents and visas must be valid for the entire duration of the trip, including any interruptions. In this regard, Aeroitalia assumes no responsibility and will not be liable for any consequences that the passenger may suffer due to their negligence in obtaining such documents.

14.2 Travel Documents

The Passenger must present, before departure, all entry, exit, health, and other documents required by the relevant states. Additionally, the passenger must provide these documents to the carrier and allow them, where necessary, to make copies or note the data contained therein. The carrier reserves the right to refuse transport to passengers who do not comply with these requirements or whose travel documents are incomplete. The carrier will not be held responsible for the consequences and, in particular, the losses and costs incurred by passengers for not complying with the applicable regulations, without prejudice to the carrier's option to refund the unused travel reservation due to visa refusal communicated to the carrier before departure for reasons not attributable to the passenger.

14.3 Refusal of Entry

In the event of a refusal of entry into a country, the passenger must bear all costs and fines imposed on the carrier by the local authorities as a result of such refusal. The carrier will not refund the passenger the cost of the purchased reservation for transport to the destination where entry was denied and may use the amounts paid for air transport if the authorities arrange for the return to the country of departure.

14.4 Passenger Liability for Fines and Detention Costs, etc.

If Aeroitalia is required to pay fines or penalties and/or incur expenses due to the passenger's failure to comply with the laws and regulations for entry or transit in a particular state or for the lack of necessary documents in the correct form, the passenger will be obliged to reimburse the carrier for all amounts paid and expenses incurred. This provision applies not only to the passenger but also to the person (if different from the passenger) who purchased the reservation on behalf of the passenger. To offset the amounts owed, Aeroitalia reserves the right to use any unused flights or any funds of the passenger in the possession of the company, such as credit vouchers, travel provided by the country of departure, destination, or transit, the passenger will be required to reimburse, upon request, any amount paid or expense incurred.

14.5 Customs Inspections

If necessary, the passenger must attend the inspection of their baggage by customs or other governmental or airport authorities. Aeroitalia will not be liable to the passenger for any loss or damage suffered during such inspections or as a result of the passenger's failure to attend the inspection.

14.6 Security Checks

Passengers must undergo security checks conducted by duly authorized personnel of governmental, airport, or airline authorities.

14.7 Communications and Complaints

For the purposes of proper handling, traceability and timely processing of requests, the official and primary communication channel with Aeroitalia is exclusively the contact form available on the website www.aeroitalia.com in the “Contacts” section.

Requests, applications, complaints, formal notices, claims for refund or compensation pursuant to Regulation (EC) No. 261/2004, as well as any other communication having contractual relevance, must be submitted through such form, duly completed in all its fields.

Communications sent through different channels (including, by way of example, generic e-mail addresses, social media channels, private messaging systems, or unauthorized intermediaries) do not guarantee proper receipt, traceability or processing within the applicable time limits and may not be considered valid for the purposes of interruption of limitation periods or forfeiture deadlines, where applicable.
The passenger retains the right to use other means provided under applicable law; however, for the purposes of proper and prioritized administrative handling, the above-mentioned form constitutes the official reference channel.

Aeroitalia reserves the right to request additional documentation and to decline processing requests that are incomplete or lacking the elements necessary to identify the passenger and the booking.

ARTICLE 15. LIABILITY FOR DAMAGES

15.1 Compensation and Liability Limits

In cases of:

  1. death or injury of the passenger;
  2. delay in passenger transportation;
  3. delay in baggage transportation;
  4. destruction, loss, or damage to baggage,

the mandatory national, European, and international regulations in force apply, in particular: the Navigation Code, the Montreal Convention of 1999, Regulation (EC) No 2027/97, as amended and supplemented by Regulation (EC) No 889/02, as well as Regulation (EU) No 996/2010, as amended by Regulation (EU) No 376/2014 and Regulation (EU) 1139/2018 of July 4, 2018, as well as ENAC Circular GEN-05 revision A of October 12, 2018.

In summary, the above regulations provide as follows:

  1. compensation in case of death or injury of the passenger: the carrier is liable for damage resulting from the death or personal injury of the passenger if the event that caused the death or injury occurred on board the aircraft or during any boarding or disembarking operations. For damages up to 128,821 SDR, the carrier cannot exclude or limit its liability. Beyond this amount, the carrier is not liable for the damage if it proves that:
    1. the damage is not due to its negligence, wrongful act, or omission, or those of its employees or agents, or
    2. the damage is due solely to the negligence, wrongful act, or omission of a third party.
  2. Advance payments: in the event of an air accident causing the death or injury of the passenger, the carrier, if required by its national legislation, shall make advance payments to the person or persons entitled to compensation to meet their immediate economic needs. An advance payment does not constitute recognition of liability and may be deducted from any subsequent amount paid by the carrier as compensation.
  3. Delay in passenger transportation: the carrier is liable for damage resulting from a delay in the air transportation of passengers unless it proves that it and its employees and agents took all necessary and possible measures, with due diligence, to avoid the damage or that it was impossible to take such measures.
    Liability for damage is limited to 5,346 SDR.
  4. Delay in baggage transportation:
    the carrier is liable for damage resulting from a delay in the air transportation of baggage unless it proves that it and its employees and agents took all necessary and possible measures, with due diligence, to avoid the damage or that it was impossible to take such measures.
    Liability for damage is limited to 1,288 SDR.
  5. Destruction, loss, or damage to baggage: the carrier is liable in case of destruction, loss, or damage to baggage up to 1,131 SDR per passenger as per ENAC regulations. In the case of checked baggage, the carrier is liable for the damage unless the damage pre-existed or resulted from the nature, defect, or inherent vice of the baggage or is related to the normal handling of the baggage or wear and tear such as scratches, dents, stains, loss, or damage to protruding or removable parts (straps, wheels, handles), unless the damage compromises the use of the baggage. For unchecked baggage, the carrier is liable only if the damage is attributable to it.
  6. Higher liability limits for baggage: passengers can benefit from a higher liability limit by making a special declaration no later than the time of baggage check-in and paying an additional fee.
  7. Baggage claims: the receipt without reservation of the baggage delivered by the person entitled to delivery constitutes, unless proven otherwise, the presumption that it was delivered in good condition and in accordance with the transport document. In case of damage, the person entitled to delivery must immediately and no later than seven days from the date of receipt, present themselves at the Lost & Found office at the destination airport, complete the PIR (Property Irregularity Report), and send a claim to the carrier. In case of delay, the claim must be submitted within twenty-one days from the date the baggage was made available. The claim must be in writing and submitted or sent within the aforementioned time limits. Failure to make a claim within the specified time limits extinguishes actions against the carrier, except in cases of fraud by the latter. The claim will not be considered in the absence of the PIR issued by the Lost & Found office.
  8. Liability of the contractual carrier and the actual/operating carrier: if the carrier operating the flight is not the contractual carrier, the passenger has the right to make a compensation claim or complaint to both. If the name or code of a carrier appears on the ticket, that carrier is the contractual carrier.
  9. Time limits for compensation actions: the liability action must be initiated, under penalty of forfeiture, within two years from the arrival at the destination or the day on which the aircraft should have arrived, or the day the transportation was interrupted. The method of calculating the limitation period is determined according to the law of the court seized for the dispute.

ARTICLE 16. ONBOARD CONDUCT

16.1 General Terms

If the passenger's conduct on board the aircraft endangers the aircraft itself or the people or objects on board, or obstructs the crew in the performance of their duties, or if the passenger fails to comply with the crew's instructions, the carrier and the aircraft commander shall be entitled to take measures to prevent the continuation of such behavior, including containment measures. The passenger may be disembarked from the aircraft, denied boarding on subsequent flights at any time, and may be reported to the competent authorities for actions committed on board the aircraft.

16.2 Portable Electronic Devices

Passengers are allowed to use small portable electronic devices during all phases of the flight, provided they are in "airplane mode." For safety reasons, laptops and larger electronic devices must be turned off during taxiing, takeoff, and landing or at any time upon the commander's request. Any device that transmits or receives communications in a mode other than "airplane mode" must be turned off for the entire duration of the flight. The use of hearing aids and pacemakers is allowed. For the use of electronic devices, passengers are still invited to follow the announcements made in the cabin.

16.3 Non-smoking Flights and Other Restrictions

Smoking is strictly prohibited on all Aeroitalia flights. Violation of this prohibition will result in the payment of penalties as provided by law, without prejudice to Aeroitalia's right to seek compensation for damages incurred. According to the applicable I.A.T.A. procedure, the ban on smoking on board aircraft also extends to electronic cigarettes.
The carrier may deem it appropriate to limit or prohibit the consumption of alcoholic beverages on board. Filming or photographing on board is prohibited, except for personal purposes. If the passenger does not comply with the provisions of this article, in accordance with legal provisions and regulations, the carrier and the aircraft commander may take all appropriate and reasonably necessary measures, including disembarking the passenger and/or applying coercive measures at any time during the flight.

ARTICLE 17. ALTERNATIVE DISPUTE RESOLUTION - EXCLUSIVE JURISDICTION

Aeroitalia informs passengers/consumers that a European platform for online dispute resolution (ODR platform) concerning consumer disputes related to goods and services purchased online in the European Union has been established. The ODR platform can be consulted at the following address: https://ec.europa.eu/consumers/odr/. Through the ODR platform, passengers/consumers can consult the list of ADR bodies, find the link to each of their websites, and propose to initiate an online dispute resolution procedure.

Notwithstanding the above and without prejudice to the mandatory jurisdictions provided by Regulation (EU) No. 1215/2012 with regard to passengers/consumers, any dispute concerning these General Conditions of Carriage and/or the Carriage Contract is subject to the exclusive jurisdiction of the Court of Rome.

ARTICLE 18. APPLICABLE LAW

The present General Conditions of Carriage and the Contract of Carriage are governed by Italian law.
